Education

Mr. Cooper graduated from Duke University (B.A. 1964) and the University of North Carolina at Chapel Hill (J.D. 1969). He has been employed by Mullen Holland & Cooper, P.A. since 1969, and is currently its Managing Director, Chairman, and Treasurer. He is a member of the Gaston County, North Carolina and American Bar Associations, and the North Carolina State Bar, and was a member of the Board of Governors of the North Carolina Bar Association from 1985 to 1988. Mr. Cooper has been a member of the Panel of Trustees for the U.S. Bankruptcy Court for the Western District of North Carolina since prior to 1975, the North Carolina Bar Association Bankruptcy Section, the American Bankruptcy Institute and has served as a commercial and bankruptcy law lecturer in the continuing legal education programs of the North Carolina Bar Association and the National Association of Bankruptcy Trustees. Mr. Cooper is certified by the North Carolina State Bar Board of Legal Specialization as a Board Certified Specialist in Bankruptcy Law. He is also certified by the American Board of Certification as a board certified specialist in both Business and Consumer Bankruptcy Law. He is also a member of the Council of Certified Bankruptcy Specialists of the American Bankruptcy Institute. He has numerous published articles and decisions.

In 2009 the United States District Court for the Western District of North Carolina (which had withdrawn the reference) stated in its Order, docket no. 131, 16 June 2009):

“. . .that this (consolidated bankruptcy case of RFS Ecusta, Inc. and RFS US, Inc., bankruptcy case nos. 03-10360 and 03-10358, and District Court case no. 3:06-cv-386) is one of this District’s best and most efficient bankruptcy case administrations, including the Trustee’s vigorous and successful prosecution of adversary proceeding claims for the benefit of the estates’ creditors. . . The Trustee, an attorney himself, and his counsel Mullen Holland & Cooper P.A. . . . (who) are very experienced and talented bankruptcy practitioners, then administered and prosecuted the bankruptcy cases, and adversary proceedings the Trustee initiated, to another level with outstanding results for the benefit of creditors that can only be described as beyond exceptional.”

Mr. Cooper practices primarily in the areas of banking, bankruptcy litigation and reorganization, and creditors’ rights. Mr. Cooper has been awarded the highest professional rating of “AV Preeminent” by Martindale-Hubbell. He has appeared in the federal district, appellate circuit courts, and bankruptcy courts in NC, NY, PA, SC, TN, VA, and in the U.S. Supreme Court in Washington, D.C.

Professional Bio

Mr. Cooper has been selected by Charlotte Magazine and North Carolina Law & Politics for inclusion on the North Carolina Super Lawyers® list every year since 2006, based on peer review and professional achievement. Only 5% of North Carolina lawyers were selected. In 2009, and again in 2010 Mr. Cooper was designated among the Top 100 lawyers of all legal specialties in North Carolina by Charlotte Magazine and North Carolina Law & Politics. Mr. Cooper has also been selected by the North Carolina Business Journal for each year 2005 through 2010 and again in 2013 as among the Legal Elite in a process involving both professional accomplishment and balloting by more than 19,000 active members of the North Carolina State Bar. Lawyers selected for inclusion in the Legal Elite represent a little more than 3% of North Carolina’s lawyers. Mr. Cooper was also selected every year since 2011 for inclusion in Best Lawyers in America and every year since 2012 in Marquis’ Who’s Who in America.
