Commercial Real Estate Representation

MHC Law is a full-service commercial real estate firm, and we are prepared to help your commercial business navigate all real estate ventures, disputes, and opportunities. To be sure, we can represent you in:

  • The purchase or sale of commercial and industrial property;
  • Commercial and industrial leases;
  • Financing;
  • Landlord and tenant issues;
  • Entitlements;
  • Construction;
  • Foreclosure; and
  • More.

We can also represent you in many real estate disputes you may encounter, including construction and land use disputes.

Real Estate Representation

Local governments, business, and property owners often require legal representation in order to defend against land use and zoning complaints and disputes, as well as provide representation and guidance in eminent domain and inverse condemnation cases. Further, local governments may lease property, acquire physical real estate property or land, and encounter questions related to real estate and environmental regulations. We have years of experience representing clients in regard to a wide range of issues, real estate included.

Landlord and Tenant Disputes

The landlord-tenant relationship can be difficult and, at some times, requires legal intervention to make sense of. Common landlord-tenant disputes include:

  • Property maintenance disputes;
  • Civil liability and negligence in the event of personal injury;
  • Rent and fee disputes;
  • Eviction;
  • Property damage disputes;
  • Subletting concerns;
  • Rental contract disputes; and
  • More.

When involving businesses, landlord-tenant disputes may also include property use disagreements. Our lawyers can represent both renters and landlords, as well as commercial businesses involved in landlord-tenant disputes. In disputes such as these, we prioritize alternative dispute resolution, but are available to provide litigation services as well.

Zoning and Local Ordinances

Zoning is used to determine what types of property can be placed upon certain lands. States and cities create statutes and ordinances related to zoning, which can be a burden for private citizens or businesses to navigate in the event of a real estate project or expansion. For local governments, complaints may be lodged about zoning ordinances, which can be expensive and time-consuming to defend. Our lawyers can help you to understand zoning and local ordinances related to your real estate project, as well as offer legal representation to local governments.

Real Estate Litigation

In addition to representing citizens, businesses, and government entities in a variety of real estate-related issues, we also have experience in real estate litigation. We always prioritise our clients’ best interests, which often means pursuing alternative dispute resolution methods prior to litigation; however, if litigation is the only way to protect your rights, our lawyers will be prepared to take your case to court. Common causes of real estate disputes that lead to litigation include:

  • Failure to disclose. Sellers have a duty to disclose certain property defects, and are in violation of this duty if they conceal defects or misrepresent defects. If a defect is not properly disclosed, a buyer has a cause of action against the seller.
  • Breach of contract. A buy-sell agreement is a legal and enforceable contract between a buyer and a seller. Should this contract be breached by either party, the other maintains the right to remedy.
  • Construction defects. When a construction crew is brought in for a remodel, renovation, or new construction project, construction defects may occur. This might include a design error or omission, or a workmanship defect. In either case, the construction company may be responsible for damages to the other party.
  • Breach of duty. Finally, realtors have a duty to act in their clients’ best interests. If a realtor breaches this duty, a civil lawsuit may be appropriate.
